Dr. Vandana Bagga, the suspended Director General of Health Services (DGHS) in Delhi, has filed a formal complaint contesting her suspension, asserting that it violates the Election Commission's Model Code of Conduct and constitutional principles. Dr. Bagga alleges that her suspension is politically motivated, aimed at benefiting a particular political party ahead of the Delhi Assembly elections.

Allegations of Political Bias and Breach of Protocol

According to Dr. Bagga, the suspension order, dated January 7, was issued under the authority of Lieutenant Governor (LG) V.K. Saxena. She contends that the order bypasses the elected government's jurisdiction over health matters, which she argues is a state subject under the Constitution.

Dr. Bagga has accused authorities of breaching confidentiality, claiming the suspension order was leaked via WhatsApp. She emphasized that this violates standard confidentiality protocols and undermines procedural integrity. Furthermore, she noted that the order lacked consultation with or consent from Delhi’s Health Minister or the Council of Ministers.

Violation of Service Rules and Natural Justice

In her complaint, Dr. Bagga highlighted that her suspension contravenes Rule 101 of the Central Civil Services (Classification, Control, and Appeal) Rules, 1965. She pointed out that no disciplinary proceedings or criminal accusations have been initiated against her, making the grounds for her suspension unclear.

Dr. Bagga also underscored that she was not provided an opportunity to present her case before the suspension was executed, a move she believes violates the principles of natural justice. She described the action as “illegal, void ab initio, and arbitrary.”
