The Patna High Court has issued a temporary stay on the appointment process for lab technicians in Bihar. The court directed the state government to clarify the situation and mandated the health department to submit a reply affidavit by April 10. 

According to media reports, the court took action following the consideration of a petition submitted by Vimla Prakash and six additional petitioners. Justice Harish Kumar, presiding over the single bench, has suspended the advertisement related to the appointments. The petitioners are contesting the recent recruitment process for lab technicians.

Advocate Shiv Pratap, representing the petitioners, stated that the Bihar Technical Service Commission issued a notification on March 3. The notification, designated as 2/25, pertains to the recruitment of 2,969 lab technicians. He indicated that the 610 vacancies listed in the new advertisement were consolidated from a previous advertisement. 

The advocate stated that an advertisement released in 2015 initially intended to appoint 1,772 lab technicians. A total of 1,162 positions were successfully filled, while the remaining 610 were subsequently included in the new advertisement. The petitioners assert that this action lacks legal validity.

They cited a Supreme Court order that directed the preservation of the 2015 advertisement's status. They contended that issuing a new advertisement for appointments while the old advertisement remains under judicial review is legally inappropriate. 

The court is treating this matter with due seriousness. The court is requesting clarification from the health department to address any uncertainties surrounding the recruitment process. The court's decision indicates a willingness within the judicial system to examine the actions of public bodies when questions arise regarding their legal validity.
