Delhi Court Rules in Favor of Pradhan Mantri Bhartiya Janaushadhi Pariyojana, Protecting Brand from Infringement

In a landmark ruling, the New Delhi District Court has issued a permanent injunction against a Bhopal-based organization operating under the name "Jan Aushadhi Sangh." The court found that the firm was deliberately using a deceptively similar name to the registered trademark "Jan Aushadhi," associated with the Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP). 


The violation was aimed at creating confusion among the public and trading on the goodwill of the PMBJP, a government initiative designed to provide affordable medicines to the masses.

The court's decision now prohibits the violator, along with its proprietors and partners, from using the "Jan Aushadhi" mark in any form. This legal victory protects the integrity of PMBJP’s brand and ensures that consumers can continue to trust and access genuine, affordable products through the official Jan Aushadhi Kendras.

In addition to the permanent injunction, the court ordered that all materials bearing the infringing "Jan Aushadhi" trademark be handed over to PMBJP for destruction. The violator was also directed to pay damages of Rs. 10 lakhs to PMBJP, reinforcing the seriousness of trademark infringement.

The Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP) was launched by the Department of Pharmaceuticals, Ministry of Chemicals & Fertilizers, with the goal of making quality generic medicines available at affordable prices. 

With a network of over 13,800 Jan Aushadhi Kendras across almost every district in India, the scheme allows people to save between 50% and 90% on the cost of medicines.

Over the years, Jan Aushadhi has grown to become the largest retail pharmacy chain in the country, providing essential healthcare access to millions.

This ruling marks an important step in safeguarding the authenticity of Jan Aushadhi products and maintaining the trust consumers have in the government’s initiative to offer affordable medicines.
