Supreme Court Allows High Court to Hear RG Kar Case, Victim’s Family Seeks Fresh CBI Probe
The Supreme Court has ordered that the Kolkata High Court's single bench can hear the family's petition in the RG Kar case. According to Chief Justice Khanna, there are no legal obstacles prohibiting the High Court from hearing the petition, which challenges the Central Bureau of Investigation's (CBI) investigation into the matter.
The case concerns the savage rape and murder of a young doctor, which outraged both the medical establishment and the general public. The victim's relatives had previously expressed discontent with the CBI probe, stating that many parts of the case were unexplored. They urged that the primary investigating agency revisit the concerns and perform a more complete investigation.
Prior to this, the victim's parents petitioned the Kolkata High Court for a review of the CBI's inquiry. However, Justice Tirthankar Ghosh of the High Court declined to consider the case at that time. As a result, the family petitioned the Supreme Court for permission to pursue their case in the High Court.
Earlier, on January 29, 2025, the Supreme Court sought clarity from the victim's family on their preferred forum for the lawsuit. The family asked that the Kolkata High Court be given the opportunity to review the deficiencies of the CBI's investigation.
Legal sources disclose that the victim's parents have previously experienced difficulties before the Supreme Court. They had already petitioned the Supreme Court, expressing their unhappiness with the CBI's role in the case. However, the Supreme Court rejected their request for a new investigation at that time.
With the recent decision, the Supreme Court has given the High Court's single bench the authority to determine whether more investigation is required. Chief Justice Khanna said, "We shall not comment on this subject. A single bench of the High Court can hear it."
The victim's parents came to Delhi on Sunday, joined by senior and junior doctors who back their call for justice. The Supreme Court has scheduled a hearing on the matter for Monday. The RG Kar case has remained a source of significant concern, notably among the medical community, which has called for stricter safety precautions and a comprehensive judicial assessment of the crime.
Monday is also notable for another reason: Justice Joymalya Bagchi, formerly of the Kolkata High Court, is scheduled to be sworn in as a Supreme Court judge. He is anticipated to take his oath at 10:00 a.m. and then join the Chief Justice's bench. Given the timeframe, legal analysts anticipate Justice Bagchi may preside over the RG Kar case hearing on the same day.
According to reports, the victim's parents have asked permission to attend the Supreme Court proceedings. However, it is unclear whether they have received the necessary passes to attend the hearing.
The victim's parents have always contended that Sanjay Roy, the primary accused, was not the only person guilty of the crime. They assume more people were involved and have asked the Supreme Court to reopen the probe. However, the Supreme Court had previously dismissed their plea.
With the Supreme Court enabling the High Court to consider their plea, the family hopes for another chance to challenge the CBI's conclusions. The High Court's next hearing on the case will likely determine the conduct of additional investigations.
